Please read these Smilescollect.co.uk (owned and operated by Affiliate
Incentive Marketing Ltd.) Reward Program Terms & Conditions, since Program
enrolment constitutes acceptance of and agreement to them:
1)
Eligibility: You must be 16 years of age or older, a resident of the
United Kingdom and have a valid e-mail address and internet access to
participate in the Smilescollect Rewards program.
2)
Account Limitation: Only one account may be used by each registered
Member; smiles in one account cannot be combined with those in any other
accounts to earn a Reward.
3)
Smiles Expiry: All Smiles earned during any calendar year (except for
enrolment bonus Smiles) expire at midnight on December 31, three years after
the year when it was earned, unless redeemed for a travel award before that
date. For example, Smiles earned any time in the year 2000 expire on
31/12/2003. Smilescollect reserves the right to cancel any account that has no
shopping activity within 6 months of the date on which it was opened.
4)
Smiles Value: Smiles have no cash value. Smiles may be redeemed only for
free holiday vouchers as defined and described in these Terms & Conditions,
subject to the restrictions contained herein, and any others that may be
added from time to time at Smilescollect's sole discretion. Destinations are
not guaranteed and may be changed to similar offers from time to time.
5)
Smiles Credit to Member Accounts: Smilescollect will post Smiles credits
to Member accounts when it receives confirmation from a participating Merchant
that the Member has: (a) made a purchase of qualifying goods or services from
that Merchant; (b) clicked through to the Merchant's website when a "click and
earn" offer is published; or, (c) taken advantage of a Merchant offer posted on
the Smilescollect website. In every case, Members must comply fully with the
respective Merchant's requirements for Smiles eligibility. Such actions must be
initiated by the Member from the Smilescollect website at www.Smilescollect.com
for Smiles credits to be earned, except in the case of Smiles credits earned
from direct award by a merchant on the merchant's website or in the merchant's
place of business. Merchant Smiles award-reporting to Smilescollect usually
happens within 48 hours of the time of the customer action, but in some cases
may take longer. Smilescollect posts Smiles credits to Member accounts only
upon notice from Merchants, and is not liable for Merchant failure to report
such purchases. Smiles earned by shopping are awarded on the basis of the cost
of goods or services purchased, exclusive of tax, shipping or any other special
charges. Smiles earned by clicking through to participating Merchant websites
will be credited only in accordance with the published requirements and
restrictions.
6)
Smiles Debits to Member Accounts: Merchants also report to Smilescollect
any credits issued to customers for cancelled orders, unfulfilled orders, returned
merchandise, refusals or inability to pay agreed commissions, etc., and upon
receipt of such notification, Smilescollect will debit such credits from
Member's account.
7)
Free Holiday Voucher Redemption, Cash Credit, Purchasing Smiles: Free
holidays must be requested from the voucher operator within 7 days upon
redeeming the voucher from smilescollect. If you have 13,500 or more smiles in
your account, but less than 15,000, you can purchase the smiles you need at the
time you Redeem a Reward at a cost of £0.025 (two and one half pence) per
smile.
8)
Smiles eligible for Free Holiday Redemption: Free holiday vouchers can
be ordered by a Member when at least 90 percent of the Smiles in the Member's
account has been there for at least 30 days. Should Smilescollect receive from
one of its Merchant partners a Smiles debit notice for smiles already credited
to a Member's account and used by the Member for a free holiday, Smilescollect
will deduct those smiles from any remaining in the Member's account after the
free holiday has been issued.
9)
Travel Reward Changes, Cancellations: Should you decide to change your
reservation or itinerary after your voucher has been issued, you will be
responsible for any fees imposed by the voucher operator.
10)
Taxes, Surcharges And Fees:
All taxes and airport fees are paid for as
long as you are travelling alone. Should you take advantage of the
subsidized cost for additional travellers, please refer to the voucher
operators for details.
11)
Transferability: Free holiday vouchers may be issued in the name of any
person designated at the time of redemption by the Member against whose account
the Reward is being debited.
12)
Lost, Stolen, Misused vouchers: Once issued, vouchers are the Member’s
responsibility. Lost, stolen or misused vouchers will not be replaced and are
the sole responsibility of the Member.
13)
Other Liability: Once a Reward voucher is issued, the Member enters into
a contract of carriage with the voucher operator, and Smilescollect will have
no responsibility or liability for any loss or damage incurred in connection
with your travels with that operator.

Validity: The program is not valid where prohibited by law

Cancellation, Revision: The program or its Terms and Conditions can be
cancelled or revised at any time, without notice except by the posting of such
changes on the program website at
http://www.smilescollect.co.uk/,
under “Terms & Conditions.” The program may be cancelled at Smilescollect’s
sole discretion, and in the event of the program cancellation, Smilescollect
will not be liable for smiles in Member accounts. Members are responsible for
periodic reviews of Smilescollect's Terms & Conditions to assure their
understanding of and compliance with them.
16)
Smilescollect’s Responsibilities: Smilescollect is not an agent or
representative of any of its merchant or other partners, and is responsible
only for awarding the published smiles Awards to its Members who take actions
that generate such Awards. Smilescollect is not responsible for any activity or
consequence of activity between its Members and its Merchant partners, or
between its Members and its Reward partners (voucher operators). Smilescollect
is not responsible for any damages which may occur as a result of purchase or
use of products or services from a merchant awarding Smilescollect smiles via
e-mail messages, directly or through the Smilescollect website. Smilescollect
makes no warranties, express or implied, with regard to any product or service
purchased through a merchant listed on its website or merchant offers made via
Smilescollect e-mails. Smilescollect is not a party to, nor cannot resolve
disputes between customers and its merchant or other partners.
17)
Fraud, Account Audit, Violation Of Terms & Conditions: Any
fraudulent act in regard to this program, or violation of Terms &
Conditions, will result in forfeiture of all smiles earned, and may also result
in prosecution to the fullest extent of applicable laws. Smilescollect's
determination that fraud has been attempted or occurred is contestable by
affected member(s) only in the venue specified in Section 21 of these Terms
& Conditions.
When
Smilescollect, in its sole judgment, believes that referral fraud may have
occurred, it shall have the right (but not necessarily the obligation) to
request from a member the name, address and telephone numbers of each person
that the member referred to Smilescollect who then allegedly joined the Program
as a result of the member's referral. Smilescollect may put Member's free
holiday request in suspension for up to 30 days, pending investigation, and may
then contact those people to determine the authenticity of the referrals.
Refusal or failure to provide Smilescollect such information within 3 working
days of the date of Smilescollect's request to the member will be interpreted
to indicate that the referral activity was fraudulent, as shall Smilescollect's
inability to confirm that people referred by the member exist and actually
joined the Program themselves, as opposed to having been enrolled directly by
the Member claiming referral credit for them. Smilescollect may also ask a
member whose ticket redemption request has been placed in suspension for other
information or documents to aid its investigation, and member refusal to
cooperate by provision of this information or documents will be interpreted to
indicate that the referral activity was fraudulent.
Member
accounts are audited for Terms & Conditions compliance and smiles deposit
accuracy upon member's submission of a free holiday request.

Privacy Policy/SPAM: You can rely on us to protect your privacy. We will
never share information about you without your permission. For more
information, see our Privacy Policy. We do not endorse or use ‘spamming’
e-mail tactics, and Members who misuse the Member Referral e-mail
forwarding options on our site to send e-mails to people whom they don’t know
can suffer account cancellation (see “Fraud, Violation of Terms & Conditions”).
19)
Referrals: Smilescollect's award of smiles credits for referrals
requires that: /a.) the referred individuals are different people from the
referring member, /b.) that they are at least 16 years of age, /c.) that they
are otherwise eligible for membership, /d.) that no more than 1 person in the
referring member's household may be referred, and /e. that the referred person
personally and directly joined the Program. Members are not allowed to directly
enrol other people.
2o)
Click Smiles Limitation: Members redeeming a free holiday voucher may
apply no more than 3,000 smiles earned by clicking to merchant websites listed
on Smilescollect's “Click n’ smile” page or Click smiles earned from responding
to advertising emails or “play n’ smile” emails. The balance of the redeemed
smiles must have been earned by: /a.) registration,
/b.) referrals,/c.) downloading “surf n’
smile” and/or, /d.) shopping.
21)
Governing law: This program is governed by the laws of England. Members
agree that any dispute or claim will be settled by the English courts.
22)
E-Mail: Smilescollect sends periodic communications to Members about the
Program, special merchant offers and other information relevant to program
participation. By registering at Smilescollect you agree to receive such
e-mail. You can opt out at any time.
23)
Acceptance of Terms & Conditions: Members who register in the
Smilescollect Reward Program accept and agree to abide by these and any
subsequently-issued Terms & Conditions at the time and by the act of their
registration.
